A group of NASA leaders led by nominated MP Godfrey Osotsi On Friday gave notice to the Director of Public Prosecutions (DPP) of their intention to initiate private prosecution on Chebukati's team unless they resign within 72 hours.
The notice document, seen by Pulselive.co.ke, accuses 13 officials including Chebukati and Chiloba of being criminally liable for electoral offences that led to the nullification by the Supreme Court.
NASA had initially indicated that it would only participate after a number officials, led by Chiloba have left the polls commission.

The previous demands had spared the IEBC Chairman but the notice of intention to start a private prosecution suggested that the Opposition had changed its mind on Chebukati and included him in the list of officials they wanted out.
In the full judgement issued by the Supreme Court, no IEBC officer was found criminally culpable but the actions of a number of officials including the ICT director James Muhati and the Chairman were criticised.
The judgement chastised Muhati for failing to fully comply with the court's orders while Chebukati was indicted for failing to verify the forms 34B with the forms 34As used in declaring results at the constituency level.
The new development further complicates the IEBC's attempt to have a new election within the 60 days deadline that elapses on October 31st.
The commission on Thursday changed the date of the repeat elections from October 17 to October 26th.
