Major blow for IEBC after today's court ruling

Justice Odunga's ruling now casts doubt on the Thursdays election.

The legitimacy of Thursdays repeat presidential election has been thrown into further doubt following Wednesdays ruling by the High Court.

Justice George Odunga on Wednesday morning ruled the process that led to the appointment of 290 constituency returning officers and their deputies was illegal.

The judge however declined to quash the gazette notice by the IEBC on the appointment of the returning officers.

The ruling will most likely lead to a challenge by NASA on the legitimacy of Thursday's election in the courts following the ruling by Justice Odunga.

On October 12, the IEBC gazetted names of Returning Officers and their deputies to conduct Thursday's elections.

All the 290 constituency returning officers are required to physically deliver their Form 34Bs as well as Form 34As supporting the constituency tally.

The National Returning Officer who doubles up as the Chairperson of IEBC will then be required to verify electronically collated results with the statutory forms and thereafter generate Form 34C.

The winner of the presidential election shall then be announced once the Chairperson verifies results captured in Forms 34A and 34B.
