Raila has asked the Supreme Court to nullify the presidential election held 10 days ago and order a fresh one citing massive irregularities and a flawed electoral process which handed President Uhuru Kenyatta the win over him.
In the 25,000 page petition Raila accused the Independent Electoral and Boundaries Commission (IEBC) of manipulating votes in favour of Kenyatta and denying him the victory in the August 8 polls.
In the petition filed by Raila and his running mate Kalonzo Musyoka, the two identified specific irregularities which include their votes being added to Kenyatta’s in the presidential tallies.
The petition indicates the IEBC and its Chairperson Wafula Chebukati as the first and second respondent with Kenyatta as the third respondent.
NASA indicates that its agents in Kenyatta’s and Deputy President William strongholds of Central and Rift Valley respectively were thrown out and replaced by impostors who created fictitious names and signed blank result forms which the coalition claims they have sufficient proof of.
According to their data analysts, NASA claimed that 14,000 out of 25,000 result forms for vote declarations had errors ranging from statutory documents not signed by returning officers, others not authenticated by the official rubber stamp and others which did not have agent names and their signatures.
The petition also states there were instances which showed that one presiding officer’s name was in charge of several polling stations at the same time.
“IEBC set out to frustrate the people’s will and deliver a flawed election. The petition asks the court to and by extension the people of Kenya to nullify the entire exercise because it is fatally compromised, in order to pave way for fresh, legitimate elections,” the statement from NASA read.
