Anerlisa Muigai sued by City millionaire over 19.9 Million

According to Court Papers seen by The Nairobian, Ms Muigai borrowed the money from a non-deposit taking micro-finance outfit (under Dennis Mwengeka), on behalf of her then boyfriend Ben Kangangi with the promise of paying back but she failed to do so.

Its reported that, Anerlisa gave cheques worth Sh4.4 million in the process of repaying the loan but they all bounced.

Going by the suit papers from Kuloba & Wangila Advocates, Anerlisa borrowed three loans totalling to Sh13 million from Mwangeka and gave two vehicles, a Range Rover Evoque (KBU 5***R) and an Audi Q7 KBX 8***N), as security.

“As the debt remained outstanding, the plaintiff received a phone call from the police Flying Squad summoning him to the police station as the vehicle being held in lieu of the loans was stolen from the defendant’s mother, Tabitha Karanja of Keroche Industries.” Reads part of the suit papers

Through her Lawyers Mungu, Kimetto & Company Advocates, Anerlisa admits to borrowing the money from Mwangeka on the diverse dates mentioned, but states that “the interest charged on the said loans is “illegal, oppressive and extortionist and therefore unenforceable.”

Ms Muigai also requested that Mwangeka should recoup the loans from Kangangi since“the said Kangangi is the principal debtor and the defendant is not liable to the plaintiff for the sums claimed and therefore does not owe any other amount.”

To clear part of the interest, Anerlisa paid Sh346,000 for her first Sh5.5 million loan, but borrowed a further Sh3.3 million at a discounted five per cent interest, as the goods at the Mombasa port had accumulated more charges.

As security for the third loan, she handed over the Audi Q7. After being summoned by police, Mwangeka surrendered the Range Rover which police said was not registered in Anerlisa’s name as it was her mother’s company car.  Days after Kangangi claimed the Audi Q7, leaving Mwengeka with no security.
