Babu Owino loses Embakasi East MP seat

The Court has made the final ruling today.

High Court Judge Joseph Sergon's decision to annul the elections comes barely a week after the Court ordered the recount.  Babu and IEBC have been ordered to pay Sh2.5 million each as suit costs.

The recount earlier found that the area MP Babu Owino won the Embakasi East parliamentary race by popular vote but the Court has annulled on irregularities account. The Judge noted that Mr Owino disrupted at Soweto Polling Centre polling in several polling stations, forcing the exercise to stop for over an hour.

In his ruling Justice Sergon indicated that Babu Owino was not validly elected further directing that a by- election be conducted in accordance to the law.

In his witness testimony on November 28, 2017, Mr. Mureithi claimed that the election exercise was marred with violence, intimidation, voter bribery among other electoral malpractices.

The tally showed that Mr Owino garnered 46,817 votes against 42,501 votes garnered by his main rival, Jubilee's  Francis Mureithi. The final vote recount tally was signed by High Court Deputy Registrars Esther Mburu and Mbayaki Wafula.

Earlier last week, there was confusion as both Owino and his rival Mureithi declared themselves victors in the Vote recount.

On January 12 2017, the High Court ordered recount and scrutiny of all votes cast in the parliamentary race during the August 8 election in Embakasi East.

Meanwhile, Babu Owino's lawyer Edwin Sifuna has affirmed that he will respect the ruling, but revealed that he is appealing the decision rendered in court.
