Court orders to Matiang'i may have had mistakes - CJ Maraga

CS Matiang'i should appeal the cases against him instead.

In a statement to address the ongoing attack on the judiciary by the executive, the Chief Justice acknowledged that while some court orders may have mistakes, the person served with the orders can only reverse them by rebutting in a Higher court.

"The orders have been issued in the normal course of business, and they could make mistakes in those orders.

"If there are mistakes that have been made, let there be an appeal. And once an appeal is filed, let the parties in the orders wait for the verdict to be  made," the CJ told the press in Nairobi.

On Tuesday, while appearing before the National Assembly Security Committee, Dr Matiang’i lamented about judicial officers he said were in a competition to embarrass the government, and stop state officers from performing their roles.

“It is an evil clique of judicial officers who want to drag us by the collar through the streets of public opinion,” said Dr Matiang’i, who insisted that the government, in the Miguna case, was condemned unheard.

CS Matiang’i has already appealed the case, in which Justice George Odunga found him in contempt of court, slapping with a penalty of Sh200,000 which would be deducted from his salary this month.
