Waiguru renews her battle with Raila

Raila is a troubled man.

The former Devolution CS now wants the High Court to allow a case she had filed particularly against Mr Odinga to proceed, saying there has been no sufficient reason why the hearing should be suspended.

“Throughout the course of this matter, Mr Odinga has made numerous attempts to delay the matter, including failing to comply with civil procedure rules and requesting adjournments on a number of occasions,” Ms Waiguru said in court papers.

The governor in court papers implored with the High Court, demanding that the matter be concluded in good time as the defamatory remarks made by Mr Odinga, Muthama and Khalwale have caused her anguish, and distress.

“I am apprehensive that further delay will prejudice me by compromising the availability of my witness and her ability to recall matters pertinent to this suit,” Ms Waiguru said of her lawsuit she filed in 2015.

She has added that the utterances by the former Prime Minister have been taken as the truth by her foes, crying foul of the bad reputation she has earned out of the blues.

Earlier, Ms Waiguru emerged as the whistle blower in the theft of over Sh971 million from the youth service, leading to her resignation from the docket.

“It is not in the interest of justice that proceedings are stayed as Mr Odinga has requested. It is only just that I am given an opportunity to clear my name in a timely fashion," Ms Waiguru said.

Stop the hearing

Earlier, Raila Odinga, through his lawyer Paul Mwangi, requested that the hearing process be stopped until he files an appeal challenging a ruling issued last November is produced, something Ms Waiguru is opposed to. The ruling allowed the governor to conceal certain information regarding her lifestyle.

Ms Waiguru is aggrieved that Mr Odinga linked her to loss of Sh 971 millions at the National Youth Service (NYS).

But Mr Odinga’s lawyer asked her to respond to, among other issues, her salary, allowances, list of properties and her financial worth, which she declined.

In the latest court papers, Ms Waiguru, through lawyer Mohammed Muigai, says Mr Odinga has not filed his appeal papers within the time stipulated in law and therefore should not be granted the orders he is seeking.

Ms Waiguru revealed a scheme by Mr Odinga to misuse the judicial process to frustrate her quest for justice.

Ms Waiguru is also after former senators Boni Khalwale and Johnson Muthama for linking her to the theft of Sh791 million at NYS.

All the linked politicians made public utterance in public to effect that the former CS misused over Sh791 million in unscrupulous deals and tenders at the NYS, through projects in Nairobi’s Kibera slums. Dozens of others have already been charged in Court.
