"Am sorry for stealing lawyer's academic work!" PLO Lumumba

Lumumba is accused of taking over 5,000 words from Maina's work. His piece is 10,000 words.

 

Despite offering to pen an apology to lawyer Wachira Maina, the credibility of Lumumba’s academic papers remain indebted.

Lumumba is also obliged to write another ‘suitable’ letter of correction and forward it to the Law Society of Kenya Journal, the Law Society of Kenya, Law Africa Publishing Ltd and East Africa Law Society (EALS) Secretary General Godfrey Kitiwa to immediately recall and delete the article from the LSK Journal Volume 11 2015.

Lumumba’s article 'From Jurisprudence to Poliprudence: The Kenyan Presidential Election Petition 2013', 10,000 words long, in court papers filed, is accused of taking part of Maina’s work and making it his, without acknowledging the initial author, contravening the copyright demands.

Apology

Lumumba and Maina recorded the consent in court Tuesday, Maina agreeing to withdraw his petition on condition that Lumumba writes an apology agreeable to him in 14 days.

Maina filed the case in court in October last year, accusing Lumumba of intellectual theft.

He accused Lumumba of lifting close to 5,000 words, nearly half of Lumumba’s final article, verbatim from his piece, which was published by the East African newspaper on April 20, 2013.

Maina had initially sought damages criticizing the Isaac Okero led LSK for failing to check the authenticity of articles before publication.

Maina also sought to have Lumumba’s conduct declared unethical, and be declared unfit to hold public office.

Lumumba served as the director of the Kenya Anti-Corruption Commission from September 2010 to August 2011.

Despite the ugly copyright confrontation, Lumumba is currently the director of the Kenya School of Law. He was appointed to the position in 2014.
