Start of legal battle pitting Government against NASA

NASA strategists had announced that their leader Raila Odinga would be sworn on the legal backing of the motion passed by the People’s Assemblies.

However, Attorney General Githu Muigai has moved to the High Court seeking to declare the formation of the assemblies illegal and unconstitutional.

“The establishment of the People’s Assemblies by the aforementioned county assemblies is an illegality as the institution is alien to the Constitution and is neither within the framework of the County Governments Act or any other legislation.”

“The establishment of the proposed assemblies is also not envisioned within the mandate and the functions of the county assemblies or indeed the County Governments. The respondents continue to use public resources in illegal activities not envisioned in the Constitution," the AG states in Court papers.

The People’s Assembly was an initiative started by Odinga in late last year and was expected to carry out to help achieve electoral justice and culminate in the Opposition leader’s inauguration.

The chief government legal advisor has stated that the matters dealt by the assemblies are the preserve of Parliament and have nothing to do with the counties.
