It was the first petition that Jubilee has won in election-related matters.

A senior Jubilee leaders has won a major case at the High Court after his opponent mad a rather hilarious mistake.

Mumias East MP Benjamin Washiali, who is also Jubilee’s Chief Whip in the National Assembly was one of the few leaders who managed to beat the NASA and get elected to Parliament from the Western region.

However, Washiali’s win was quickly challenged by a candidate who had run on a NASA ticket.

ANC’s David Wamatsi’s election petition has now become the first to be thrown out of the tens of cases that were filed after the August 8 election.

On Thursday, the High Court in Kakakmega ruled dismissed the petition after it was found that the NASA candidate used a fake lawyer to prepare his affidavits.

The election documents were signed by a quack and did not have the relevant stamps by a commissioner of oaths.

Wamatsi, through his lawyer Moses Munoko, had acknowledged the affidavits were defective, but requested the judge to allow him amend or re-swear the affidavits to conform to the legal requirements. The request was not granted.
