Blow for Karua in Waiguru case after Today's Court ruling

Karua had admitted she did not include the crucial evidence she claimed went missing

The High Court blocked Karua from producing video evidence of alleged poll malpractices in the case.

Kerugoya High court Judge Lucy Gitari ruled Karua's evidence as inadmissible saying the application was irregular and without basis.

According to Justice Gitari, the video in the custody of the witness was taken by a phone and later subjected to a process through a computer to make the video, raising questions on its authenticity or clarity of document and therefore did not meet the safe guard conditions.

A fortnight ago, Karua admitted that she did not include the crucial evidence she claimed went missing in the initial affidavits she filed in court in her case against Waiguru.

The confession threw the whole case into a spin after an earlier confusion at the Kerugoya High Court when the piece of evidence was reported to have mysteriously disappeared from the petition case.

The court directed the deputy registrar to produce judiciary staff who received Karua's petition with Justice Gitari directing the staff to explain how Ms Karua's flash disc containing video evidence on voter bribery got lost from the file.

"There is a wide conspiracy. Court has a duty to get to the bottom of the matter. It is incumbent upon this court to exhaust its own internal inquiry. Bring the person who wrote the receipt to explain," Ms Karua had complained.
