High Court final ruling on Matiang’i & Boinnet

PS Immigration Gordon Kihalangwa was also punished alongside the two. The ruling was made on Thursday by High Court judge George Odunga.

"They have clearly shown that they have no respect for rule of law," he said.

Mr Odunga said that he could not jail Mr Matiang'i and Boinnet since they were the law enforcer and their juniors would not comply with the court ruling to jail them.

"The respondents are in charge of the security of our country. They are in charge of executing orders. It's clear they won't abide with the orders. None of their juniors will implement the order," Odunga said,

The judge further ruled that the amount should be deducted from their salaries.

"Each of the first, second and third respondent are hereby directed to pay a fine of 200,000 shillings that will be deducted directly from their next months salary," Odunga mentioned in the ruling.

The three were found guilty of contempt of court after failing to produce self-declared National Resistance (NRM) General Miguna Miguna in court even after three orders were issued.

They were ordered to appear before the same court on Wednesday at 2.30pm but they failed to do so.

They are also accused of holding Mr. Miguna incommunicado at the Jomo Kenyatta International Airport (JKIA) despite instruction to release him.
