Fresh twist in Miguna's deportation saga after Government's latest move

Immigration Director Gordon Kihalangwa complied with the court orders on Wednesday  and surrendered the document.

The passport was perforated and defaced when Mr Kihalangwa presented it in court

“In compliance with orders issued on February 15, we attach the perforated passport of the applicant. The compliance, however, is without prejudice to our client’s rights to challenge the legal validity of the orders issued by the court," lawyer Fred Ngatia told the court.

According to the Immigration boss the defacing of a passport is a standard procedure for all deported individuals.

The Government deported Mr Miguna to Canada claiming that he had revoked his Kenyan Citizenship and was in the country illegally. However, he challenged the decision through his lawyer John Khaminwa.

"I will challenge all the illegal and unconditional actions by the despots in court starting today (February 8). I have instructed a battery of competent advocates to ensure that the ongoing rogue purveyors of impunity are brought to book," he said.

Last week, Justice Luka Kimaru ruled that Miguna's deportation was illegal and directed Mr Kihalangwa to surrender the passport within seven days.

"That a declaration be and is hereby issued that the manner in which the Respondents conducted themselves resulting to the purported cancellation of the citizenship of the Petitioner, revocation and confiscation of his passport and other identity documents and the declaration that he was a member of a prohibited class and a prohibited immigrant and removal from Kenya were done in violation of the rule of law and in direct contravention of provisions of the constitution,” he said.
