Judge's new order that could block Alfred Keter from vying in the by-election

When releasing the full ruling, High Court Judge George Kanyi Kimondo directed the Director of Public Prosecutions (DPP) to investigate for voter bribery and campaigning outside stipulated time.
The judge stated that the Court was satisfied that Keter committed electoral illegalities that undermined the credibility of the August poll.
“Having scrutinized both evidence, I have noted illegalities committed by the second respondent during the said exercise…. the first respondent committed various electoral illegalities. I hereby order fresh elections to be conducted by the second respondent,” ruled Judge Kimondo.
In this regard, Justice Kimondo ordered the DPP to conduct criminal investigations against Keter since the Judiciary has no such mandate.
If found guilty, Keter will be locked out of the by-election resulting from his vacation from office.
According to the Electoral Offences Act, "a person who is convicted of an offence under this Act shall not be eligible for election or nomination in an election for a period of five years following the date of conviction".
