The Court instructed the police to ensure that Miguna appears before it at 2 pm after he missed the morning session.
Justice Luka Kimaru warned Inspector General of Police Joseph Boinnet and Directorate of Criminal Investigation George Kinoti against a confrontation with the court.

Miguna suffers asthma attack
On Sunday, the former Nairobi Gubernatorial aspirant's lawyer Edwin Sifuna disclosed that he (Miguna) had suffered an asthma but denied medical attention.
However, the Opposition leaders have divulged that they are not aware where Miguna is being held.
“It’s true. We received info that Miguna has suffered an Asthma attack. I have with me an inhaler but the OCS has become hostile. He won’t let me see my client give him the medication. #FreeMigunaMigunaNow #freemigunamiguna,” Sifuna posted.

The arrest of Mr Miguna has been denounced with many describing it as unlawful.
NTV news anchor Larry Madowo tweeted: "I disagree with Miguna Miguna on a lot and he’s still not welcome on my show but I don’t support his illegal detention. If you support the government infringing on one citizen’s rights, do you think it will respect yours?"
At the same time, Thirdway Alliance party leader Ekuru Aukot challenged President Uhuru Kenyatta to ensure Miguna was released.
"My advise to : last year, we respected the court order that declared you duly elected. We now ask you to respect the court order to release and to lift the . You also swore to uphold our constitution," Aukot said.
