The One Order Maraga Gave to Chebukati Today

Maraga crucial ruling today

Mr. Maraga directed the Wafula Chebulati-led Independent Electoral and Boundaries Commission (IEBC) to submit forms 34 A, B and C used during the fresh presidential election held on October 26.

The six-judge bench made the ruling following an appeal by activists’ lawyer Julie Soweto who argued that it was critical for the petitioner to scrutinize the election materials.

The ruling which was read by Justice Smokin Wanjala also instructed the electoral body to avail a certified copy of the voters' register.

“The (IEBC) is hereby ordered to grant access to all original Forms 34A, Forms 34B, Form 34C. The (IEBC) is also to avail a certified copy of the voters’ register at the costs of the petitioner. The remaining prayers are hereby declined,” the ruling read in part.

However, Soweto’s plea to access the IEBC Servers, Kenya Integrated Election Management System (KIEMS) logs, memory cards and other tech details were thrown out.

The judges termed this request as a ‘fishing expedition’.

Mr. Wanjala explained that this was because time could not allow for all the processes. He noted that the full details would be given at a later date.

The CJ went further to ask IEBC’s lawyer, Waweru Gatonye, to ensure his clients give the petitioners’ team access to the crucial documents.

At the same time, the petitioners and President Kenyatta were instructed by Mr. Maraga to appoint seven people each to do the job.
