Munya demands access to KIEMs kits used in Meru in August 8 polls

Probably Munya might take another U-Turn, but that has to be weighed again.

The former Chairman of the Council of Governors, and senatorial loser Mugambi Imanyara on Monday applied to be allowed access to the county KIEMS kits used in the August polls before the repeat presidential elections slated for October 26.

Mr Munya last month challenged the election of Kiraitu Murungi as the Meru Governor in the August 8 polls, and is set to present eight witnesses in his case against IEBC’s 14.

On his part, the defendant, Mr Murungi, will present four witnesses to argue out and cement his victory in the protracted victory.

Earlier, through his lawyer Martin Gitonga, Mr Munya expressed fears that the KIEMS kits will be tampered with, when and if they are used during the presidential rerun. IEBC’s  lawyer Lucy Kambuni, however, dismissed the allegations.

Justice Gikonyo gave orders that Munya, the IEBC and Murungi serve one another on or before Monday.

He said Munya’s requests for production of election materials will be set and determined by the court.

There was heated debate over the legality of affidavits filed before court by Munya.

On his part, however, through his lawyer Mutuma Kibanga and Kambuni Kiraitu, Mr Kiraitu argued that the affidavits are additional documents and are against elections rules.

The new demand by then Mr Munya comes barely a week after he pledged to work with the incumbent governor, promising to bury their political hatched.

“It is only one affidavit filed in support of the petitioner. Others are annexure affidavits and offend elections rule Number 12, as they do not constitute evidence,” Mr Mutuma, Kiraitu’s lawyer told the court session.

In response, Gitonga said, “The petitioner filed the entire bundle. In the event the court finds the petitioner did not file them in order, then for service of justice, let the petitioner be allowed to file them in an orderly manner.”

Just a fortnight ago, Mr Munya pledged support for Nasa presidential candidate Raila Odinga, who would late decamp to Uhuru Kenyatta’s camp, owing to the mounting pressure from his PNU party. Mr Munya, in the company of President Uhuru Kenyatta pledged to work with Mr Kiraitu in developing Meru.

It is not, however, clear whether the former Chairman of the council of governors will withdraw his lawsuit against his main challenger.
