Miguna's lawyer summoned by DCI

The lawyer was summoned through a phone call.

Havi, through his twitter handle, said that an officer at the George Kinoti led Unit called him via phone on Tuesday afternoon, urging him to appear at the facility to shed light on the alleged confiscation of his client’s Canadian passport.

“A Mr Kuria from DCI-Serious Crimes summoned me on phone at 12.31pm, to go shed light on the confiscation of Miguna’s Canadian Passport. I asked him to request CS Matiang’i, PS Kihalangwa, IG Boinnet & DCI Kinoti to first comply with all Orders on the matter, before summoning me,” Havi said on Twitter.

Earlier, Mr Havi in affidavits sworn in court papers claimed that Miguna’s passport had been confiscated by the Kenyan authorities, only to emerge later that Dr Miguna ‘actually had his passport in Dubai before he left for Canada last month.’

Perjury accusations

Miguna equally yelled at the pilot in the botched deportation late last month that he neither had his passport, nor the luggage. He would later in long Facebook post brag that he refused to hand over his passport for stamping at the JKIA, in fear of confiscation.

“The respondents (government) have unlawfully seized the petitioner (Mr Miguna’s) Canadian passport in a clear attempt to have him declared stateless and continue to violate his fundamental rights,” Mr Havi had said in an affidavit dated March 27 in a case that sought Dr Miguna’s release from detention at the Jomo Kenyatta International Airport (JKIA).

In addition, another lawyer, Cliff Ombeta, who also represented Dr Miguna, insisted that the legal team’s position was that “the passport had been snatched from Dr Miguna at JKIA.”

Earlier, Kenyan authorities on Monday evening gave details of a plan to establish how the deported lawyer “got back his Canadian passport”, after he swore that the State had impounded it at the Jomo Kenyatta International Airport prior to his second deportation.

“We are trying to establish how he got the passport for onward travel since it is on record even in court that it was lost,” Interior ministry spokesman Mwenda Njoka said.
