Big win for Wavinya Ndeti after final ruling

The IEBC had earlier nullified her candidature as a Wiper candidate.

On Wednesday, the High Court ruled that Wavinya was eligible to contest for the Machakos governor's seat on a Wiper Party ticket.

Two weeks ago, the Independent Electoral and Boundaries Commission (IEBC) nullified the nomination of Wavinya as the Wiper candidate on the grounds that she was a member of two parties at the same time; Wiper Party and CCU.

The ruling followed a successful petition by MCA Peter Kyalo.

The petitioner, a member of Wiper, had argued that Ndeti should be disqualified from the race.

Wavinya later moved to court to challenge the IEBC decision that would have technically locked her out Machakos race.

In the case documents, she said she resigned from her former party, Chama Cha Uzalendo, on April 5 and joined Wiper.

She also alleged that both parties entered into a coalition agreement when the dispute of her being in two parties arose before the Political Parties Dispute tribunal.

She insisted that she is now a registered Wiper party member hence the verdict by the IEBC committee was unfair and has a huge implication on her political career.

She further alleged that there are records that indicate which party she currently belongs to and is seeking to be elected.

The IEBC ruling now clears the way for her candidature as she seeks to unseat the incumbent Alfred Mutua who is running on his Maendeleo Chap Chap Party.
