Maraga certified a case filed by presidential candidate Ekuru Aukot challenging the decision by IEBC to remove other candidates from participating in the fresh election.
According to Aukot there was no legal ground for IEBC to remove other presidential candidates from the list and allowing only President Uhuru Kenyatta and NASA flag bearer Raila Odinga to participate.
“The judges said that the election was not held in accordance with the dictates of the Constitution, rule of law and the regulations and therefore they declared the presidential election invalid, null and void which means there was really no election.
“If you repeat this election afresh it means all the parties which participated in the annulled election must be on the ballot. It is upon them to choose whether they wish to take part or not,” he said.
The lawyer told the court that he was eligible to take part in the new poll.
CJ Maraga certified the case as urgent to be heard on September 18, 2017.
