Matiangi’s new order on NGOs de-registration

Acting Interior Security Cabinet Secretary Fred Matiangi has ordered for the suspension of de-registration of Africa Centre for Open Governance (AfriCOG) and Kenya Human Rights Commission (KHRC).

Addressing the press on Wednesday, Matiangi ordered for the suspension minutes after the Police and Kenya Revenue Authority (KRA) officials raided the the Africa Centre for Open Governance (AfriCOG) offices in Lavington, Nairobi for allegedly operating illegally.

The CS wrote to the Executive Director of the NGO Coordination Board Fazul Mahamed putting off further action against the Kenya Human Rights Commission and the Africa Centre for Open Governance AfriCOG for 90 days.

"In the meantime, I direct you to suspend any action on these organisations for up to 90 days to enable the principal secretary's committee work with these organisations to meet the regulatory and compliance needs of the NGO Coordination Board to avert any distraction of the activities," the letter read in part.

On Monday, the NGO Coordination Board de-registered KHRC for allegedly operating four illegal bank accounts in contravention of section 12 (4) of the NGO Coordinations Act No.19 of 1990.

The Board listed that KHRC had failed, declined or refused to pay statutory taxes to the Kenya Revenue Authority (KRA ) amounting to Sh100 million as provided under the schedule 10 of the Income Tax Act.

The Board also stated that KHRC's financial statements failed to give a true and fair view of their final position and it could not ascertain the Sh1.2 billion it received could fully be accounted for.
