DCI Kinoti & DPP Haji removed from Sarah Cohen's case
On Monday, Justice Lydia Achode said the DPP and the DCI have no interest in the Cohen estate since they are holding the property declared a scene of a crime.
In her ruling, Justice Achode stated: "I find that the DPP and DCI cannot be enjoined in the suit because they are not dependents of the deceased."
The DPP had sought to be allowed to leave the succession case saying his office does not handle such matters.
Through her lawyer, Philip Murgor, Ms Wairimu was seeking to have the DPP and DCI retained for not handing over her part of the property.
Murgor told the court the DPP and DCI had illegally seized his client's matrimonial home, registration LR No.2591/499, on Farasi Lane at Mugumoini Close in Lower Kabete.
He stated that they seized the property under the guise of an ongoing probe, alleging that it was a crime scene.
