Senior Principal Magistrate Teresiah Nyongena, approved the application file by Haji to have the charges of manslaughter dropped after it was discovered that the case had been tampered with by two senior detectives carrying out the probe.
The move by the DPP was prompted by the revelation made by DCI boss George Kinoti in regards to the case where the lawyer is accused of shooting dead his son Joseph Bogonko Nyakundi.
Kinoti disowns manslaughter charge against Nyakundi
Kinoti on Wednesday had disregarded the charges imposed on the embattled Nyakundiand had ordered a public inquiry to how two detectives and two prosecutors had been involved in a 'cover up' operation of the matter.
“Once we finish the inquiry and they are found culpable, we will charge them with conspiracy to defeat justice,” stated Kinoti.
He further explained that he had not been briefed of the case and learnt of the charges through the media.
