The appeal was made by Machakos MCA Peter Kyalo, the same person who complained to the Independent Electoral and Boundaries Commission (IEBC) over the legality of Ms Ndeti's nomination.

Mr Kyalo is contesting the judgment by Justice Odunga, allowing Ms Ndeti to vie for the Machakos Gubernatorial seat.

On Wednesday, Mr Odunga ruled that Wavinya was eligible to contest for the Machakos governor's seat on a Wiper Party ticket.

Earlier, the electoral body nullified the nomination of Wavinya as the Wiper candidate on the grounds that she was a member of two parties at the same time; Wiper Party and CCU.

The petitioner, a member of Wiper, had argued that Ndeti should be disqualified from the race.

However, Ndeti told the court that she resigned from her former party, Chama Cha Uzalendo, on April 5 and joined Wiper.

She also alleged that both parties entered into a coalition agreement when the dispute of her being in two parties arose before the Political Parties Dispute Tribunal.

The former CCU party leader insisted that she was now a registered Wiper party member, hence, the verdict by the IEBC committee was unfair and has a huge implication on her political career.
