According to reports, the court halted the cremation or burial pending the hearing and determination of case filed by a woman who claims to have child with the Kibra MP.
The complainant, Anne muthoni Thumbi, claims to have a child with Ken Okoth.
She moved to court on Thursday to request for an injunction stopping funeral plans, until she is recognized as the Late lawmaker’s bonafide partner.
Certified as urgent, the court directed that the interred plans set for Saturday be stopped until the case is heard and determined.
Thumbi – a Nairobi MCA – named the late legislator’s mother Angeline Okoth, his wife Monica Okoth as well as the Lee Funeral Home as respondents in the case.
“That in the interim a temporary injunction be and is hereby issued restraining the 1st and 2nd defendant (Okoth’s mother and wife), either by themselves, their servants or agents from conducting the burial, interment, cremation and or in any manner whatsoever dispose of the body or remains of the late Mr Ken Okoth pending the hearing and determination of the instant application interparties,” read the directive.
