The moves comes after DPP Noordin Haji returned files related to the case to the anti-corruption, directing the body to question mmore people linked to the controversial deal.
The DPP also wants former Attorney General Githu Muigai to record a statement over the Ruaraka school land saga in which several high profile politicians and businessmen have been named.
The former AG reportedly recorded a statement at the commission on Thursday with sources confirming that the CS who had earlier on recorded a statement is expected back on Monday following the developments.
EACC had submitted a list of 26 individuals who it recommended for prosecution in relation to the deal.
Among those recommended to be prosecuted is National Lands Commission chairman Muhammad Swazuri and two other senior commissioners.
The scandal has left two public schools- Ruaraka Secondary School and Drive Inn Primary School staring at eviction after it emerged that they are sitting on private land.
Lands Cabinet Secretary Farida Karoney on Monday informed the Senate County Public Accounts and Investment Committee that the allotment letter issued to the two schools 34 years ago was irregular.
