Reports indicate that the man identified as David Mwai committed suicide inside the police cells under unclear circumstances.
Mwai allegedly confessed to police officers of having been contracted to assassinate Mr. Muhtar before his demise.
On August 18, Mwai targeted the ex-Garissa official at the parking of a restaurant near the Kileleshwa mosque where he had attended 8 pm prayers.

CCTV footage shows the assassin meticulously closing in on his target, shooting him three times then walking away to a motorcycle that was waiting for him outside.
The shooting of Muhtar saw flying squad detective conduct an operation which led to the arrest of Mwai, Garissa Governor Ali Korane’s bodyguards, a soldier said to be a county security adviser, the owner of a car that was trailing Muhtar for several days before his shooting, a bodaboda rider, and a woman.
Mr. Muhtar is currently admitted at the Intensive Care Unit at a Nairobi hospital.
Activist Boniface Mwangi has poked holes into the death of Mwai stating that it was impossible for anybody to commit suicide inside the police cells. He claimed that it could be a cover-up for those who hired Mwai to kill Muhtar.
Mr. Mwangi has called on Mwai’s family and friends to contact him so that they can seek justice into the matter.

"If David Mwai is your family, text/WhatsApp me on 0792 788 638- we must get him justice. I am not defending a cold blood killer but it is wrong to be murdered inside a police cell. We live in a country with laws. David’s murder is to help a bigger murderer get away, the governor.
All evidence points to Garissa Governor Ali Korane as the mastermind who hired a gunman. The assassin, David Mwai was paid Sh1.8 Million and was supposed to get a plea bargain and become a state witness and the were paid to kill David while he was in lawful custody. ,” he said.
Pulselive.co.ke could not independently verify Mr. Mwangi’s claims.
Nonetheless, Governor Korane was on Thursday interrogated by the Directorate of Criminal Investigations (DCI) concerning the shooting of Muhtar.
Kenyans raised controversial questions regarding the death of Mwai with many demanding that police officers manning the cells be questioned.

City lawyer Ahmednassir Abdullahi tweeted: "The Kenyan police are very professional and competent. Kenyans shouldn't worry about the murder case of Mr. Muktar. The ONLY TIME KENYAN POLICE CAN'T SOLVE MURDER CASES IS WHEN THEY DO IT THEMSELVES. And in Muktar's case, it seems the tender wasn't open but was single sourced."
