Justice Charles Yano ruled that Nakumatt Holdings had failed to pay rent, service charges and the promotion fund hence giving Ideal Location Limited - the owners of the mall - liberty to evict the retailer.
At the same time, Judge Yano also directed Nakumatt to pay all outstanding balance and any payments accrued to the landlord at the date of vacating the business premises.
Through lawyer Willis Oluga, Ideal Locations Ltd had wanted the troubled firm to pay all its accrued debts upon exit from the property.
Mr Oluga claimed that Nakumatt has on numerous occasions deliberately defaulted to pay rent, service charge and promotion fund when it falls due.
The latest court order comes barely two months after Nakumatt’s Nanyuki branch was closed after the tenant evicted the supermarket over debt and goods looted.
The branch had not been operating for about two months.
