Lawyer in Dr Alfred Mutua petition claims life is in danger

The case challenging Mutua's re-election took an interesting twist after some lawyers were accused of commissioning fake affidavits.

Machakos High Court had earlier restrained the Director of Public Prosecution (DPP) and the Director of Criminal Investigation (DCI) to cease any further interrogation of Mr Lagat for allegedly commissioning a fraudulent affidavit in the petition, a claim he vehemently denied.

Dr Alfred Mutua’s lawyer had told a court session earlier that Wavinya’s lawyer had commissioned fraudulently acquired affidavits against him.

Machakos High Court Justice Roselyne Aburili issued the order prohibiting the prosecution of the lawyer who commissioned affidavits in support of a petition. She had directed the police to desist carrying out any investigations.

Justice Aggrey Muchelule, the trial judge, ordered Lagat's apprentice to shed light on the disputed signature on the affidavits.

The court was satisfied that indeed the lawyer was the one who commissioned the said affidavits.

Mr Lagat, in his defence, told the court that shortly after he appeared in court on December 11, 2017, the county criminal investigations officer visited his residence in the company of Flying Squad officers.

He said that it was there that they threatened his family to the effect that they will face dire consequences. The matter is set for mention on 24.
