High Court Judge Joseph Sergon nullified the Emabakasi MP's election on basis of massive irregularities.

The Judge ruled that Mr. Owino had disrupted at Soweto Polling Centre polling in several polling stations, forcing the exercise to stop for over an hour.

Justice Sergon stated that Babu Owino was not validly elected and he ruled that a by-election be conducted.

The former student leader was also ordered to pay Sh2.5million as legal costs for the petition
