Orengo lands new job with IEBC

The Senator will be IEBC's lead lawyer on a sensitive legal battle

Orengo was picked to represent the electoral commission and one of its returning officers in a petition challenging the election of Siaya Governor Cornel Rasanga.

The Senior Counsel, who is also the Siaya Senator, has in the past been on the opposing side with the IEBC, including representing NASA leader Raila Odinga in a case where the Supreme Court nullified the August 8 election.

Despite the past history, Orengo led a spirited legal battle against former Rarieda MP Nicholas Gumbo who had challenged Rasanga’s win.

On Wednesday afternoon, the Siaya High Court became the subject of a rare battle of wits as Orengo poked holes into an expert document produced by Gumbo, detailing irregularities Rasanga and IEBC officials allegedly committed before, during and after the August 8 elections.

Gumbo, who run as an Independent candidate, had submitted an expert document by James Mandegu to support his petition on irregularities and illegalities that reportedly saw the Siaya Senator re-elected.

However, the Senior Counsel told the court that Mandegu’s document had glaring errors and that he lacked relevant knowledge and experience to become an expert.

He also accused Gumbo of plagiarism some of his supporting documents.

"In this case, I think you ought to have engaged the services of a forensic expert, not just anybody.

"You risk committing plagiarism and you know the consequences that come with it," he said, noting the law is different from the engineering the witness practice,” the veteran lawyer stated.

The Senator further stated that Mandegu's CV clearly demonstrated he had never handled such a matter in court and that he had only been to a "myriad of seminars".

Gumbo defended his case against Rasanga, telling the presiding judge that it did not require a forensic expert to prove variance in election results.

"Statistics is statistics and variance is variance. Anybody who has done mathematics and statistics can see that. We need not to seek the services of a forensic expert," Gumbo pleaded before presiding judge Esther Maina.

The heated court session attracted a huge number of locals who had come to witness the legal battle.

Orengo and Gumbo are also political rivals with the Senator having endorsed Rasanga after accusing the former Rarieda MP of being a Jubilee mole.
