In the ruling on Wednesday morning, Justice Chacha Mwita directed that the matter be postponed until October 9, 2018 pending determination of constitutional matters in the petition.
Deputy CJ Mwilu had earlier filed a petition before the High Court seeking to stop criminal proceedings against her over charges of abuse of office and graft.
She argued that Mr Haji was motivated by malice and his allegations are malicious and the case was not coincidental and appeared to be part of a larger scheme to embarrass her as the country's second top judge.
The move by the High Court is a blow to Director of Public Prosecution Noordin Haji who on Tuesday said he had gathered enough evidence that Mwilu had abused her office for personal gain.
The DPP while addressing the media said he had earlier informed CJ Maraga of his decision to grant consent for the arrest and prosecution of the Deputy Chief Justice on criminal charges.
“The evidence in our possession shows that DCJ Mwilu abused her office, obtained execution over security belonging to Imperial Bank which is now under receivership under false pretences, and engaged in unlawful failure to pay taxes," he stated.
