ODM Governor loses his seat

Awiti lost an election petition filed by his closest rival in the August 8 election - Oyugi Magwanga.

Homa Bay High Court judge Justice Joseph Karanja ruled that Awiti was declared Governor in a flawed process which did not meet the threshold for a free and fair election.

Awiti and Magwanga have had a running political rivalry that was witnessed during the election petition.

On one occasion, the lawyers for the two rival politicians called for the court to be adjourned after supporters to the two camps started shouting down each other during a court hearing.

Magwanga was represented by Charles Kanjama while Awiti had hired Prof Tom Ojienda as his lead lawyer.

The Homa Bay County boss becomes the second governor to lose his after Wajir's Ahmed Mohammed Abdi Mahamud, whose election was nullified following a successful petition on January 12
