The DPP moved to to the Court of Appeal seeking to overturn an earlier High Court decision that blocked investigations on Joho's academic qualifications.
The Mombasa Governor had sought to block DPP, the Inspector General of Police and the DCI from investigating him, stating that the probe was meant to harass him and threaten him over his political position.
Mombasa High Court Judge Erick Ogola ruled that the probe was meant to discredit the governor, adding the investigations were untimely.
Justice Ogola noted that the timing was suspect given that the governor had faced a similar investigation in 2013 which was concluded in court.
However, Mombasa assistant DPP Alexander Muteti has told the Court of Appeal that the judge misdirected himself by assuming that the investigation against Joho was politically instigated.
The Mombasa governor has been given 14 days to respond to the case.
