Nairobi MP loses Parliamentary seat

Mawathe’s election was challenged by his rival Irshad Sumra who vied on an Orange Democratic Movement (ODM) Party.

Presiding over the case, Court of Appeal judges Daniel Musinga, Mohammed Warsame and Kathurima M’inoti ruled that the Independent Electoral and Boundaries Commission (IEBC) should hold another election in the Constituency according to the law.

Mr. Sumra moved to the Court of Appeal after High Court upheld the victory of Mawathe, who was elected on a Wiper Party ticket.

The former Embakasi South MP argued that Mawathe was not validly elected.

Speaking to journalists after the ruling, Sumra stated that he was confident that he will win the by-elections.

ODM Secretary General Edwin Sifuna said: "We the family are elated this morning following annulment of the Embakasi South Parliamentary elections following a successful appeal by Hon. Sumra. We hope that the will of the people shall prevail when the by-election is held."
