The move comes after President Uhuru Kenyatta’s failure to appoint Warsame to the Judicial Service Commission, a move that has caused jitters in the judiciary.
High Court rulling
In July, the high court cleared path for Justice Warsame’s appointment after deliberations that the National Assembly did not have a role to play in his appointment as a commissioner.
Justice Enock Mwita had agreed with the appointment indicating that Judge Warsame had been elected by his peers.
“Subjecting persons duly elected by peers as required by the law approval by the National Assembly will not only expose them to ridicule, possible political patronage and horse-trading, but would defeat the spirit of the Constitution” ruled Mwita
This is the second attempt by LSK will be trying to compel the executive to appoint the Judge as they have opted to seek the court’s intervention.
