Muturi rejects ouster of nominated MP from party

This is not acceptable

Speaker of the National Assembly Justin Muturi on Friday rejected the proposal to remove Nominated MP Godfrey Osotsi from the Amani National Congress (ANC) party.

The Musalia Mudavadi led party through a letter, had requested Muturi to remove Osotsi’s name among the nominated MPs list.

"Kindly accept this letter as a formal request by ANC party beseeching you to commence the requisite statutory procedures and attendant actions with respect to the said Hon Osotsi as befits a nominated MP whose membership of the sponsoring party has been terminated," read a part of the letter.

The speaker however stated that the decision could not be effected as the party had not followed the correct procedures as stated in the constitution.

"We acknowledge with thanks receipt of your letter. However, we are unable to take any action on this matter until provisions of articles 103 and 105 of the constitution have been complied with," read the letter from Muturi.

Osotsi files petition in court

The embattled lawmaker had on Tuesday moved to the constitutional division court in a bid to challenge the decision to have him kicked out of the party.

Through the petition, Osotsi had claimed that ANC had consistently, deliberately withheld essential information that would have enabled him to respond to the charges made against him and facilitate his application for an appeal or review.

Two months ago, Dan Ameyo, who is the party disciplinary committee secretary, had notified the legislator of complaints of financial misconduct allegedly raised by the Auditor General.
