In the surprise ruling, the apex court overturned the rulings made by the High Court and the Court of Appeal that Awiti’s election was marred with irregularities and illegalities.
The Governor’s election had been challenged by his main challenger in the 2017 General Election, former Kasipul MP Oyungi Magwanga.
Magwanga was ordered to pay the costs of the petition from the High Court, the Court of Appeal, and to the Supreme Court.
The election was initially nullified by the High Court after which Awiti moved to the Court of Appeal that upheld the lower court’s ruling, prompting the county boss to move to the Supreme Court.
Siaya Governor Cornel Rasanga is the only Governor to lose his seat through an election petition in 2013. He later recaptured his seat through the by-election.
