In her detailed judgement, Justice Philomena Mwilu raised several irregular issues that were committed by the IEBC, but singled out one particular error that was individual committed by Chebukati.
Mwilu quoted the IEBC Chairman on the night when he declared Uhuru Kenyatta as President-elect.
The IEBC Chairman had stated that his announcement was based on the 291 forms 34B where he also announced that he had not verified them with the forms 34A in light of a decision by the Court of Appeal.
Chebukati’s decision was, however, criticized by Justice Mwilu who indicated that the IEBC Chair, erred in failing to verify the constituency results contained in the form 34B with forms 34A that had been declared at the polling station.
Mwilu added that the constitution was clear that the commission and the returning officer had a duty to verify all the results.
“Apart from the duty to verify, the IEBC has a duty to ensure that whatever method is used is simple, secure, accountable, and transparent,” Mwilu stated, adding that she was convinced that the IEBC and its Chairman had failed in this activity.
Among other issues that the Supreme Court judges listed as contributing to the nullification of the presidential election included the poor transmission network system used by the IEBC, as well as inconsistencies of the presidential votes with other seats that were cast on the same day.
