Mutahi Ngunyi's message to Babu Owino after his win was nullified

Mutahi’s words comes after High Court Judge Joseph Sergon annulled Owino’s victory. The vocal MP and IEBC were ordered to pay Sh2.5 million each as suit costs.

The recount earlier found that the Embakasi East MP wan the parliamentary race by popular votes but the Court annulled his win on irregularities account.

The Judge noted that Mr Owino disrupted the voting process at Soweto Polling Centre  and several  other polling stations, forcing the exercise to stop for over an hour.

In his ruling Justice Sergon indicated that Owino was not validly elected further directing that a by- election be conducted in accordance to the law.

In his witness testimony on November 28, 2017, Mr. Mureithi claimed that the election exercise was marred with violence, intimidation, voter bribery among other electoral malpractices.

The tally showed that Mr Owino garnered 46,817 votes against 42,501 votes garnered by his main rival, Jubilee's  Francis Mureithi. The final vote recount tally was signed by High Court Deputy Registrars Esther Mburu and Mbayaki Wafula.

Speaking after the ruling, Mr. Owino blamed President Uhuru Kenyatta and Deputy President William Ruto for the loss stating that they had interfered with the Judiciary.

"The whole nation knows that this is a war of the President and Deputy President against Babu Owino. I have opposed them and now they are fighting back. The President is controlling the judiciary [sic],” Mr. Owino said.

Babu mentioned that he respects the ruling but will appeal the judge's decision at the Court of Appeal.
