Weitethie ward representative Julius Macharia was arrested in Kiambu after police linked him to a matatu bearing a controversial photo of Deputy President William Ruto.
The photo displayed on the matatu depicted DP Ruto in military regalia that is associated with the Commander-in-Chief designation.
The MCA was in the matatu when police approached him and after a discussion he was taken into custody.

The driver of the 14-seater matatu, one George Ngugi, was also apprehended and the two will be presented in court on Tuesday.
The vehicle also had graffiti depicting the Kenyan Coat of Arms as well as the map of the country and the Kenyan flag.
Police were yet to explain the charges brought against the MCA with some speculating that they perceived it as an act of treason.

DP Ruto has been making headlines following an insinuation that he assisted Opposition leader Raila Odinga in getting his appointment to the African Union (AU) as well as his former Prime Minister appointment.
A section of Jubilee MPs have also asked Dr Ruto to resign from his position if he is finding it hard to follow the president's directives.
