Addressing the press on Tuesday, Siaya senator James Orengo questioned why the electoral body wanted to amend the law despite the court's ruling."In which interest is this appeal made? That's mischief and we will not participate in the elections of 2017," Orengo said.

On August 8, the court ruled that presidential results declared at the constituent level would be final. However, IEBC chairman Wafula Chebukati disputed the ruling stating that it could lead to chaos. "I was dismayed by that ruling for the simple reason that presidential results are supposed to be announced at the national tallying center by the national returning officer, who is the chairman of the IEBC. That is very clear in the law," Mr Chebukati affirmed.

The NASA team has maintained that they will only participate in the elections if they are free and fair.

“The process should invoke open balloting where constituency coordinators are randomly picked and their constituencies selected," Isiolo deputy governor Gulleid Mohammed told the electoral body.
