DPP suffers major setback after today’s ruling on Mwilu case

Court issues final word

On Wednesday, Mwilu’s legal team of 34 lawyers obtained a court order stopping Mwilu from taking a plea in the corruption case filed by the DPP.

However, the order turned out to have technical mistakes, with Mugambi declining to abide by it until it was corrected.

The proceedings were then adjourned to Friday when the order with the correct file number was presented to the magistrate’s order.

However, the Deputy Director of Public Prosecutions Dorcas Oduor noted another error in the High Court order which referred Mwilu as a petitioner before the Magistrate’s court – rather than as an accused person.

Mugambi, however, allowed noted that the order would still stand despite the minor error.

The parties were asked to return to the magistrate's court on October 22nd for further directions.
