In a letter to Mr Odinga by court’s registrar, Ms Esther Nyaiyaki, she said that three documents were also missing from the NASA petition.
“As at 21st August 2017, our records are still missing one copy of volume 31, 55 and 56,” part of the letter read.
It adds, "Upon inquiring from the Supreme Court, we were advised that you were still filing court documents as at midday on Sunday. Our client is concerned as to why documents are still being filed way out of time."
When contacted, NASA lawyer Paul Mwangi said that some of the documents were not crucial adding that the primary ones were already filed.
“They are Forms 34 A. They are not primary documents. However, a document is deemed to have been filed when it was paid for and, in this case, that was done before Friday midnight. That is the legal position,” Mr Mwangi stated.
On the other hand, NASA co-principal Musalia Mudavadi has warned the judiciary that they will not accept a two-minute decision.
“We feel passionate that justice will be served this time round because we have a tight case presented to the court," Mudavadi affirmed.
The Opposition leader has refused to conceded defeat to President Uhuru Kenyatta after he was declared the winner by IEBC in the just concluded Elections.
Odinga has maintained that the results were computer-generated in favour of Kenyatta by individuals who used the late Chris Msando's logins to gain access.
