Former Nairobi Governor Evans Kidero has made a comeback in government with President William Ruto bringing him on board in latest appointments.

Kidero has been appointed to serve as the Kenya National Trading Cooperation chairperson for a period of three years.

He replaces Hussein Tene Debasso whose appointment was revoked.

His appointment was made via Gazette Notice No. 14795, dated November 15, 2024 with the appointment taking effect immediately and running for three years.

“In exercise of the powers conferred by section 6 (1) (a) of the State Corporations Act, as read together with section 51 (1) of the Interpretation and General Provisions Act, I, William Samoei Ruto, President of the Republic of Kenya and Commander-in-Chief of the Defence Forces, appoint Evans Odhiambo Kidero(Dr.) to be the Chairperson of the Board of Directors of the Kenya National Trading Corporation, for a period of three (3) years, with effect from 15th November, 2024. The appointment of Hussein Tene Debasso is revoked," read the Gazette notice.

Kidero has been in the political wilderness for a while, having lost the Homabay gubernatorial contest to Gladys Wanga in 2022.

He was among 50 nominees announced by President William Ruto last year to serve in the Chief Administrative Secretary (CAS) position.

Kidero was nominated to serve as the CAS in the Ministry of Investments, Trade &amp; Industry.

The appointment however hit a wall after High Court dismissed the appointment of all the 50 Chief Administrative Secretaries (CASs) as unconstitutional.

Other appointments made on Friday saw the Nairobi Rivers Commission reconstituted with Millicent Omanga replaced after she rejected the appointment.

In the world of politics, where debates are meant to be conducted with words, some politicians have let their tempers escalate into physical altercations, leading to unexpected slapstick moments.

The amusing and, at times, disturbing instances when politicians, figures of authority, found themselves caught in the act of slapping others.

In 2005, the late Mrs. Kibaki, then in her late 60s, became infuriated when her neighbor, who happened to be the World Bank country director and also her tenant, hosted a late-night party that disrupted her peace.

Following a report by the Nation media group detailing how she entered the party and insisted that the music cease, Mrs. Kibaki besieged the newsroom in the early morning hours to express her dissatisfaction with the coverage.

During this incident, she physically slapped a Nation cameraman who was filming her impassioned protest. Subsequently, she faced legal action for assault, but the case was ultimately dismissed.

Former Laikipia North MP Mathew Lempurkel faced assault charges in 2016 after slapping the then Laikipia North MP Sarah Korere at Harambee House in Nairobi.

The altercation, documented in court records, resulted in Lempurkel being sentenced to 12 months with no option for a fine by Senior Principal Magistrate Hellen Onkwani.

In 2013, a confrontation between then-Nairobi Governor Evans Kidero and former Nairobi Woman Representative Rachel Shebesh made headlines.

The altercation, which occurred in Kidero's office and spilled into the public sphere, saw Kidero physically striking Shebesh.

The aftermath led to a legal battle, culminating in a settlement where Shebesh received compensation of Sh30 million.

Former Nairobi Governor Evans Kidero has been relieved of a significant tax burden amounting to Sh427 million as a result of an out-of-court settlement in a tax arrears dispute.

In a formal settlement agreement submitted to the Court of Appeal, Dr Kidero, who held the position of Nairobi's Governor from 2013 to 2017, secured an exemption of Sh407,780,612.

As per the documented agreement, the former governor is now responsible for paying only a mere Sh19,989,183 out of the total Sh427,269,795 that had been originally sought by the tax authorities.

Under the terms of the settlement, Dr Kidero will now only be required to pay a reduced sum of Sh19,989,183.

This amount comprises the principal tax owed, which is Sh12,038,982, along with a penalty of Sh2,407,798.76 and an interest of Sh5,036,405.

The legal representatives for Dr. Kidero, James Ochieng Oduol and Leparashao Naeku Patricia, filed the consent agreement in court.

They acknowledged that the interest component might change depending on any adjustments to the assessments in the iTax system and agreed to such variations.

The court endorsed this out-of-court settlement between Dr Kidero and the Commissioner of Investigations and Enforcement at the Kenya Revenue Authority (KRA), effectively clearing him of the substantial tax arrears.

In the recorded consent agreement, Dr Kidero and the KRA agreed on a total payment of Sh19 million, which encompasses a penalty of Sh2,407,796 and an interest of Sh5,036,405.

This resolution marks a significant reduction from the initial tax demand of Sh427,269,795 that KRA had sought to collect for the years 2011, 2012, and 2015.

The dispute initially began in 2016 when the KRA audited Dr Kidero's financial and business records for the period spanning from January 2011 to December 2015, resulting in a tax bill of Sh680 million, inclusive of penalties and interest.

Dr. Kidero contested this taxation at the tax appeals tribunal, asserting that Sh423 million of the owed amount constituted campaign donations.

However, after the tribunal ruled in his favour, the tax authority appealed to the Supreme Court, which determined that he could not provide sufficient evidence that the money originated from his campaign accounts.

Consequently, the KRA was permitted to collect the disputed sum.

On Thursday, March 16, President William Ruto revealed the names of 50 new Chief Administrative Secretary (CAS) nominees.

The National Assembly has been given the task of approving the nominations. Among those named in the list are former Nairobi Governor Evans Kidero, former nominated Senator Millicent Omanga and Benjamin Washiali among others.

In 2018, former President Uhuru Kenyatta established the CAS position, which the High Court deemed unconstitutional in 2021 but subsequently legitimized in February 2023.

Then, Uhuru stated that CASs would collaborate with their respective Cabinet Secretaries (CSs) to improve efficiency across the entire government.

In the ministry leadership hierarchy, the CAS is directly under the Cabinet Secretary and above the Principal Secretary. Besides good salaries, the CASs will enjoy other benefits and perks.

The duties of the Chief Administrative Secretaries include addressing matters related to the assigned portfolio and establishing a connection between the bicameral Parliament, county governments, and the Ministry on issues of shared interest and concurrent mandate.

The nominations have however sparked negative reactions from the general public who lament the government is too bloated to be funded by the struggling taxpayer.

The appointments also come in the wake of a call for mass action by opposition leader Raila Odinga who says President Ruto's government is doing nothing to reduce the cost of living.

The Public Service Commission (PSC) in Kenya has shortlisted 224 individuals for Chief Administrative Secretary (CAS) positions.&nbsp;

Among them are media personalities and politicians who lost in the 2017 General Election.

The list includes both allies of current President William Ruto and former President Uhuru Kenyatta, who created the position.&nbsp;

Interviews will begin on March 1, and successful applicants will serve on contracts determined by the President himself.&nbsp;

PSC received 5,000 applications for the 224 positions, and Kenyans have been invited to submit petitions regarding the shortlisted candidates.&nbsp;

Although it is not yet clear how many positions Ruto will appoint, sources say he may appoint 23.

Among the most notable names are former news anchors Linda Ogutu and Mwanaisha Chidzuga. Ms Ogutu left KTN in 2021 to serve as the head of the Football Kenya Federation (FKF) Secretariat.

In 2022, Chidzuga vied for the Matuga Constituency parliamentary race on a UDA ticket but lost to Kassim Sawa Tandaza of ANC.

President Ruto’s digital strategist Dennis Itumbi was also shortlisted for the position of CAS, barely a month after he was appointed to the Talanta Hela council.&nbsp;

Among election losers who have been shortlisted include former Nairobi Governor Evans Kidero, former Senator Millicent Omanga, Former Kirinyaga Woman Representative Purity Ngirici, former Kiminini MP Chris Wamalwa, Former Kakamega Senator Cleophas Malala, Former Narok Governor Samuel Tunai, and Bishop Margaret Wanjiru.

Others on the list lost during the UDA primaries such as former Laikipia Woman Rep Catherine Waruguru, former Starehe MP Charles Njagua, and Macdonald Mariga.&nbsp;

<h3>Judge rules on legality of CAS positions</h3>

The Law Society of Kenya recently lost their case challenging the establishment of CAS position, after Employment and Labour Relations Court judge, Justice Monicah Mbaru, ruled that the PSC had lawfully created the position.

This ruling now allows the PSC to invite applications for <a href="https://www.pulselive.co.ke/news/local/how-chief-administrative-secretaries-cas-will-be-recruited/hcd49tz">job vacancies that were advertised in October 2022</a>, which the LSK had halted by suing.

The decision made by the court serves as a relief for President William Ruto’s allies, who lost in the 2022 General Election, as they are the main beneficiaries of this ruling.

The CAS positions include responsibilities such as responding to issues, providing liaison with the National Assembly and Senate, and coordinating with county governments.

The LSK argued that the creation of the CAS office was illegal and would lead to a bloated wage bill, which could potentially duplicate the roles of principal secretaries.

The society opposed the creation of the CAS office, citing the country’s struggling economy and financial constraints facing the government.

However, the court ruled that the creation of the CAS office conforms to the principles provided for in the Constitution and ensures no duplication of roles between CAS and principal secretaries.

Former Nairobi Governor, Dr. Evans Kidero has tested positive for Covid-19 disease.

This comes just a few days after he took his first dose of the covid-19 vaccine.

In a statement, Kidero said that he exhibited symptoms of the novel coronavirus disease and went in for a test together with members of his family on Tuesday, and <a href="https://www.pulselive.co.ke/news/local/former-nairobi-governor-evans-kidero-speaks-on-his-return-to-politics/j0t76mb">his result turned out positive</a>.

“I got vaccinated against Covid-19 last Monday (29/03/2021) which was followed by Covid-19 like reaction three days later. We all had covid tests done yesterday as a family, whose results I have just received. Everybody else is negative except me,” said the former Nairobi Governor.

He added that he was going into isolation for the next two weeks until he recovers.

Dr. Kidero called on members of staff that he had interacted with to get tested for the Covid-19 disease and adhere to the set protocols by the Ministry of Health.

Former Nairobi Governor Dr. Evans Kidero has opened up on his return to politics after almost four years of being in the cold.

Speaking to Pulse Live, the former Governor referred to himself as a missionary and he has the desire to change people’s lives for the best, which is why he ran for office.

He went on to say that he still has the desire to continue serving the public, and given the opportunity he will do it without hesitation.

“Certainly. It’s a calling. In life we have two types of people, missionaries and mercenaries. Mercenaries work for themselves and do things for themselves, but missionaries have got a burning desire to impact people’s lives positively, add value and make a difference, and that’s what made me run as governor of Nairobi, and I still have that desire of serving the public, so given the opportunity at the right time, I will go out and continue,” said Dr. Kidero.

While responding t the question of where he will vie, following reports that he was considering the County of Homa Bay, Dr. Kidero said he is a Kenyan, and if the people of Homabay go calling, he will definitely respond to their call.

“I’m a Kenyan and as a Kenyan you can run anywhere… if the Homabay people so decide that I go and serve them, I will respond positively,” he said.

The former Nairobi Governor insisted that he has not been missing in action, and his silence is because he has given elected individuals the chance to work for the people, adding that he does not want to be the one criticizing the elected leaders.

“I haven’t been missing in action and I think what I have done, I’ve given the people who are elected the opportunity to execute their mandate because it’s a lot easier to criticize when you are on the outside and I didn’t want to be the person who’s criticizing. I wanted people to see,” said Dr. Evans Kidero.

In her ruling, Justice Mumbi Ngugi indicated that the search warrants issued to Dr Kidero in September 2018 did not breach the law.

According to the former governor, the EACC's search warrants were vague.

Together with his wife Susan Mboya, Dr Kidero accused EACC of violating their privacy during a raid.

“In my view, there was no violation of the second petitioner’s (Dr Mboya) rights in the search mounted on the residential premises in which she and 1st petitioner (Dr Kidero) reside,” Justice Ngugi stated.

He further claimed that some of the properties listed were purchased before he joined Mumias Sugar Company and politics.

However, Justice Ngungi stated that the warrant authorised EACC to investigate unexplained assets owned by Dr Kidero and such investigation.

EACC claims that Dr Kidero wealth is estimated at Ksh9 billion, arguing that it was acquired during his tenure as CEO of Mumias Sugar Company and Nairobi governor.

Nairobi Governor Mike Sonko on Thursday released an audio recording of a phone call between Kariobangi MCA Julius Maina Njoka and Kitisuru MCA Alvin Olando Palapala.

The release came after MCA Palapala accused Governor Sonko of using pubic resources to cover a trip to the US by First Lady Primrose Mbuvi and her daughter Saumu Mbuvi.

In the recording, Palapala is heard describing in detail the ways through which he and other MCAs used to misappropriate county funds during Dr Evans Kidero's regime.

Na kuzidishia, ni mtu tungekufia na yeye ikiwa angekuwa mtu wa kutusaidia (I will go to heaven! At this point, no one can save the Governor, not you, not Warutere, not even Mark, it will be very hard to save him. Moreover, we would have gone down with the Governor if only he would have been good to us these past two years)," Palapala begun his narration.

The MCA went on to lament that Governor Sonko had sealed all the avenues the MCAs used to exploit to embezzle public funds during former Governor Kidero's administration.

"Maina, can you comfortably say that you have Sh1.5 million somewhere lying idle in a bank for emergencies? I know you can't. Then you ask me, Palapala, to clap my hands for the Governor knowing that he even took me to EACC? Never!

"I've been telling you and you don't want to listen, I don't think you know what it means to be re-elected. During Kidero's time, we would go, not to Kidero but to Luke Gatimu (ex-Nairobi County finance official) and we would tell him, 'award that tender quickly, I want to collect my 10% cut' and he would do it. Kidero would never follow up on such things. During Kidero's time, if a fire destroyed property in your ward you as the MCA would be given Sh500,000 or Sh600,000 out of the disaster management fund and no one would ask you to account for how you spent it. We would just buy mattresses and pocket a clean Sh200,000 or Sh300,000 not like nowadays," the MCA elaborated.

Palapala added that Dr Kidero did not follow up on bursaries either asserting that Governor Sonko had to go because he had tightened controls on the ward finances.

On Thursday, Wajir Woman Representative Fatuma Gedi was left nursing injuries at The Karen Hospital after Wajir East MP Rashid Kassim slapped her.

Gedi said Kassim confronted her at the parliament buildings parking lot and demanded to know why the Woman Rep, who sits in the Budget Committee, had not pushed for allocation of funds to Wajir East.

The confrontation got heated and Kassim slapped the Woman Rep as fellow politicians and other witnesses watched.

The Wajir Woman Rep was later taken to Karen Hospital for first aid treatment before recording the matter at Parliament Police Station - OB 20/13/6/2019.

The attack has become the talk of the town and was even a topic of conversation on the Maina and King’ang’i show on Friday Morning.

Sadly this is not the first time female politicians have been assaulted by their male colleagues.

Here are some other incidences that grabbed headlines across the country:

<ul><li>Shebesh slapped by Kidero</li></ul>

In September 2013, former Nairobi Women rep Rachel Shebesh stormed Governor Evans Kidero’s office at City Hall. A heated verbal exchange ensued and quickly turned physical after Kidero started wagging his finger at her before dispensing a slap. The altercation was captured on video and widely circulated on social media.

“Ayaaayaaa! Kidero, you have slapped me?! You have slapped me Kidero? You have slapped me?” an angry Shebesh cried out in the video as Kidero retreated into his office.

It was said that during the clash, Shebesh pinched Kidero’s nose and kicked his ankles but the incident was not captured on camera.

A year ago, Mweiga MCA Njuguna Kawanjiku was accused of punching his college Beth Nyawira at the County Chambers before taking off.

Nyawira was punched following a disagreement over committee positions in the Nyeri County Assembly and before fleeing the crime scene, Njuguna is said to have threatened journalists against reporting on the incident.

3. Kisii Ward representative Vs Moticho MCA

On November 13th 2018, Jane Justin a Kisii ward representative claimed that Moticho MCA Evans Mokoro slapped her in front of their colleagues.

Ms Jane claimed that in addition to the slap, Mr Mokoro had been sexually harassing her with lewd videos.

“Had it not been for the intervention of the sergeant at arms, I could be in hospital today,” The ODM nominated ward rep told Nation Newspaper after the assault.

Away from slapping colleagues, Evans Mokoro was recently charged with defiling a 16-year-old girl between June 2016 and September 2017 in Nyamarambe area, Gucha South.

<ul><li> Millie Odhiambo and Moses Kuria</li></ul>

Things got ugly during the passing of the Security Laws Bill 5 years ago resulting to an attack on Suba North MP Millie Odhiambo. Millie who served as the MP of Mvita Constituency at the time of the incident claimed that she was punched by her college Moses Kuria. Allegations that Moses Kuria denied but in a March 2019 interview Millie reiterated that Moses Kuria assaulted her.

“The public has the culture of mob justice and I like the person that asked me what happened during the amendment of the security law. What were you told? Millie undressed when what actually happened I was beaten by men and undressed by men but what did people believe, that I undressed myself. Do you believe I undressed? I was beaten and you know Millie is kichwa ngumu. They were stopping us from reaching the speaker who was somewhere like you. So when we’re coming from here Jubilee were more than us. So none of us could reach the speaker.
