Interior Cabinet Secretary Fred Matiangi, Inspector General Joseph Boinnet and Immigratio PS Gordon Kihalangwa are at risk of being declared unfit to hold public office after being found guilty of contempt of court.

Each of the men was fined Sh200,000 which will be deducted from their salaries.

Justice Odunga ruled that he could not find the three unfit to hold public office but he declared that they violated Article 10 of the Constitution.

Odunga spared the officials the six-month jail term, ruling that the court cannot issue orders in vain as he knows it will not be possible to arrest and jail them.

According to The Standard, this means that any citizen could petition for their removal.

“The three officials have conducted themselves in the most despicable manner and the most appropriate order is to issue a declaration they have violated Article 10 of the Constitution for repeatedly disobeying court orders to release Miguna,” Odunga ruled.

The judge added that the three officials have failed to honour the oath of office they took by conducting themselves in a manner that does not inspire confidence, adding that any person is at liberty to seek further actions against them.

Lawyers interviewed by The Standard following the ruling said the it put the three in real danger of losing their positions.
