Embattled IEBC CEO Ezra Chiloba on Monday received a major boost in his bid to stay on as head of the electoral commission.
The High Court dismissed a case where three voters had moved to court seeking to bar Chiloba and several other commissioners from participating in the repeat election.
The voters, Brian Asin, Ben Wanasakami and Kevin Alwangâa, had cited the findings of the Supreme Court on illegalities and irregularities in the conduct of the August 8 Presidential election.
Chiloba and the IEBC team responded through lawyer Evans Monari where they argued that the electoral commissionâs officials had not be found culpable and that they should be allowed to carry out their mandate without being intimidated.
âIf you grant orders sought by the petitioners then you will have taken the powers of the tribunal, executive and parliament,â Monari submitted to the court.
High Court Judge John Mativo ruled in favour of Chiloba's team and ruled that the petition against them did not have merit and was not grounded in law.
