The court through a three judge bench; Alnashir Visram, Wanjiru Karanja, and Martha Koome prevented Mombasa County from ousting residents living in estates which had been earmarked for demolition.

Earlier High court judge P J Otieno had given a nod to the County government to demolish and construct after he came to a conclusion that the public were involved.

Later in December 2016 a group of humanitarian organizations; Transparency International, Legal Advice Centre, Haki Yetu, and St Patricks made an application in Court to avert the County from kicking out tenants.

In their application through lawyer Willies Oluga, they noted that the move to evict tenants did not invite public participation. They further cited that the County government failed to seek views of key stakeholders in the design, conceptualization and planned implementation of the project.

Mr Oluga said, “How the respondents intend to relocate people they do not have a record of is baffling. The respondents ought to have identified the genuine and legal tenants, not only for the purpose of relocation but also for their participation in the project at inception.”
