The Ethiopian known as Ali Elema Wario has been charged with being a member of the terrorist group Al Shabaab.
Wario was also charged with being in the country illegally after he was found without a valid pass, permit or visa authorizing him to remain in Kenya.
Wario however denied the charge of being an Al Shabaab member before Milimani Law Courts Senior Principal Magistrate Kennedy Cheruyiot.
State Prosecutor Everlyn Makia told the court that Wario used to communicate with Mohammed Ibrahim Muhamood, the man who was killed at DP Ruto's home in Sugoi, through a cell phone.
"Police from the Anti-Terrorism Police Unit (ATPU) discovered through their investigations that the accused is still communicating with members of Al Shabaab," Makia told the magistrate.
Muhamood was shot dead after an 18-hour siege at Sugoi.
He was killed by General Service Unit personnel who were flown from Nairobi.
Muhamood gained entry into Ruto's home after attacking a GSU officer manning the gate using a machete.
He later proceeded into the armoury at the home where he accessed weapons he used to fend off security officers who responded for close to 18 hours before he was gunned down.
