Several members of the ANC, a constituent party of National Super Alliance (Nasa), had challenged the gazette notice which communicated to the members the decision to appoint Mr Muluka as the party’s Secretary General.
Eight members of the party in November last year filed two petitions before Registrar of Political Parties Lucy Ndung’u to quash the appointment of the political analyst and publisher.
The petitioners had protested the move by the NASA co-principal to appoint Muluka, saying the process was not procedural and not consistent with the party constitution.
Contacted for a comment, Mr Muluka maintained that the decision to have him as the Secretary General was unanimous done by the party members, in fact, in his absence.
“I did not chose myself as the Secretary General, I was handed the mandate by the party. They went to the Tribunal because they wanted to hold both the parliamentary seat and the Secretary General seat, which is impossible,” Mr Muluka told Puselive.co.ke on phone.
He added: “I am waiting for the next decision by the party. If it appeals, then it is fine; I hope they look into the legalities of the process itself.”
A gazette notice dated October 30 indicated that Muluka had taken over from Godfrey Osotsi who was nominated to the National Assembly.
Muluka was appointed to the post on October 12 after a meeting of the party’s National Executive Committee in Nairobi. The group said Muluka was imposed on members by the committee, demanding that a fresh election comprising of party officials be held to elect the secretary general.
Meanwhile, the Tribunal has termed as illegal the earlier process to oust nominated MP Godfrey Osotsi as Illegal from the party. In February, Mr Osotsi was on the spot over an alleged misuse of Sh57 million allocated to the party.
